MAGIC OF LAW AMONG TUKANG People of the Book

[1]. Ibn Qudamah rahimahullah said: "Abu Hanifah rahimahullah said: 'Tailor magic from among the People of the Book should also be killed. It is based on some traditions, and because of the magic it is a crime that requires the killing of Muslims who do it, so that the murder was to be imposed on the dhimmis, [1] as a punishment for murder. '"[2]
[2]. Al-Haafiz Ibn Hajar said: "Imam Malik rahimahullah said:" People of the Book Artisan magic should not be killed unless the magic that he killed someone else, so he had to be killed. '"
In addition, he also said: "If the magic that he imposes a harm to the Muslims who have never made an agreement with him, it is because of these actions, the agreement was canceled and allowed to kill. While the Prophet sallallaahu 'alaihi wa sallam did not kill Labid bin al-A'sham because he did not take revenge for his own self. Moreover, because he was afraid to kill him would cause a scandal among the Muslims and the unity of the Ansar. "[3]

Ibn Qudamah rahimahullah said: "The people who treat magic, if it is done by using some verses of the Qur'an or some dhikr, oath, speech that is not prohibited (by agama.-ed), then there is no problem (be). But if the treatment was carried out with a few things that contain magic, then Imam Ahmad ibn Hanbal silence "[6]
[2]. Al-Haafiz Ibn Hajar rahimahullah said: "Regarding the Prophet sallallaahu 'alaihi wa sallam.
"An-Nusyrah (Treatment magic with spells and incantations) including acts of Satan." [7]
Can be answered that the act was a gesture to the original. Any person who intends to cure it as a benefit, then it will be good and if not, then it is an evil. "
Furthermore, Ibn Hajar revealed: "But, it could be that there are two kinds nusyrah." [8]
I say that this is true, because treatment with nusyrah it consists of two kinds.
1). Nusyrah allowed is the magic eliminate the Koran, prayer-prayer and dhikr disyari'atkan.
2). Nusyrah prohibited, namely the treatment of magic with magic, to ask for help to the devil and approach them and seek their good pleasure. [9]
And maybe, this is the kind of treatment that is intended nusyrah in the words of the Prophet sallallaahu 'alaihi wa sallam
"An-Nusyrah (treatment against spells and spell magic with) including acts of Satan."
How can such treatment will be allowed, while the Prophet sallallaahu 'alaihi wa sallam has provided the ban came witches and shamans in many hadith, and explained that the people who justify them, then he has Kufr to what was revealed to him (Muhammad sallallaahu' alaihi wa sallam).
3). Ibn Qayyim rahimahullah said: "Nusyrah means treating the magic of the enchanted, which consists of two kinds.
[a]. Treating the same magic with magic, and this is including acts of Satan, and it is also directed to the opinion of Hasan al-Basri. Thus, people who treat it that way and treated have approached the devil with what is preferred by the devil, so it will be canceled (by the devil) actions of people who enchanted.
[b]. Nusyrah treatment using ruqyah, ta'awu-Essence (invoke protection) and prayer-prayer is allowed. Then the latter is allowed. "
