[1]. Raihmahullah Imam Malik said: 'A magic that did penyihiran are not done by someone else for him, his parable is like what was spoken by God Tabara wa Ta'ala in His Book:
"Meaning: And they knew that those who trade it (the book of Allah) with the magic would have no advantage for him in the afterlife ...." [Al-Baqarah: 102]
Therefore, I found the people to be killed if he himself doing it. [1]
[2]. Ibn Qudamah rahimahullah said: "The punishment of witches were killed. It was based on what was narrated from 'Umar,' Uthman ibn 'Affan, Ibn' Umar, Hafsa, Jundub bin 'Abdillah, Jundub bin Ka'b, Qais bin Sa'd and' Umar bin 'Abdul' Aziz. It also became the opinion of Abu Hanifa and Malik. "
[3]. Al-Qurtubi rahimahullah argues: "The jurists have different opinions on the law of witches Muslims and dhimmis. Imam Malik found a Muslim when doing their own magic with a greeting that can make kufr, then he must be killed without being asked to repent, nor repentance be accepted, because it is an act which is done with pleasure as the zindiq or adultery. And because Allaah has called it as kufr magic through his word:
"That is; Being both not teach (something) to anyone before saying, 'We are only for trial (for you), because disbelieve not ...' "[Al-Baqarah: 102]
Such is the opinion of Ahmad ibn Hanbal, Thawr, Ishaq, Ash-Shafi'i [2] and Abu Hanifa. "[3]
[4]. Ibn Mundhir rahimahullah argues: "If there is someone who claims that he has been doing magic with words that lead to kufr, then he shall be killed if he did not repent. Likewise, if he is guilty of doing so and there is evidence to suggest (that) words in the form of kufr.
If the speech he mentioned that he had been doing magic with this statement does not include a (speech) that kufr, then it should not kill him. And if it is evil in people who bewitched, it is required to qisas punishment for him if he did it intentionally. And if it does not include measures that do not require Qisas him, then he must pay diyat (fines). "[4]
[5]. Al-Haafiz Ibn Kathir rahimahullah said: "The scholars who argue about the pagan witch, has made the following paragraph as a proposition:
"That is; If they were faithful and devoted .... "[Al-Baqarah: 103]
As narrated by Imam Ahmad ibn Hanbal and some scholars of the Salaf. Some say: "No need dikafirkan, but his sentence was cut off his neck," as narrated by Imam Shafi'i, and Ahmad, both of which said, "Sufyan ibn 'Uyainah been reported, from' Amr ibn Dinar, where he had heard Bajalah bin 'Abadah said: "Umar ibn al-Khattab has decided that you kill every sorcerer both men and women." Then we were killing three witches. "
Furthermore, Ibn Kathir said: "This hadith is also narrated by al-Bukhari in his Saheeh book." [5]
He also said: "This is the account that is authentic mention that Hafsah, Mother of the Faithful, had been bewitched by his slave girl, then she told that she was murdered, so that the woman was killed.
Imam Ahmad said: "Justified history of three friends the Prophet sallallaahu 'alaihi wa sallam about the murder of a witch" [6]
[6]. Al-Haafiz Ibn Hajar rahimahullah said: "According to Malik, witch is the same law with the law in force at the zindiq, where repentance is not accepted, and killed as a punishment if it is proved to him. The opinion was also expressed by Ahmad. "
Shafi'i said: "Artisan magic should not be killed unless he has confessed that he had killed people with his magic, so he had to be killed because of it." [7]
summary:
From the above it seems clear that jumhur Scholars argue require the killing of witches, except Imam Shafi'i rahimahullah course, in which he stated that witches do not have to be killed unless the magic that he killed people, so he should be punished Qisas.
