Rulings for Bribing the Tax Employee
Question:What do you think about someone who give some money to the customs and excise official so that he’ll be free from paying his tax, reasoning that this kind of tax is not in accordance with the teachings of Islam? Is this payment considered as bribery?
An answer issued by Sheikh Sulaiman ar Ruhaili:
Giving some money to the customs and excise official to be hindered from paying the tax is not allowed because it is considered as bribery, and the Prophet has cursed the briber, the bribed one, and their intermediary.
The scholars said, ‘It is not allowed to eliminate the unclean with an unclean material.’
The unlawful matter should not be avoided with an unlawful matter too.
The Prophet said that the rulers will be asked for their responsibility regarding their obligation, and the common people will also be asked for their responsibility regarding their obligation.
Hence, you shouldn’t commit the unlawful thing to be saved from the unlawful thing done by others, because you’ll be responsible for this unlawful act of yours. And if there are other people committing unlawful thing, then they are the ones that will be responsible for it. Beware of committing the unlawful things.
